Terms of Service

These Terms of Service ("Terms") govern your access to and use of warm.me, a non-custodial donation front-end for public blockchain networks, together with any related websites, applications, APIs, and services we operate (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What the Service is
warm.me lets creators generate public donation links and lets supporters send cryptocurrency to those links. Every transfer happens directly between the supporter's wallet and the recipient's wallet on a public blockchain. We do not take custody of, freeze, reverse, pool, or otherwise control user funds at any point.
We do not operate a money-services business, an exchange, a broker-dealer, or a payments institution. The Service is informational and interface-only.
2. Eligibility
By using the Service you represent and warrant that:
- You are at least the age of majority in your jurisdiction and are legally able to enter into a binding contract.
- You are not located in, under the control of, or a national or resident of any country or region subject to comprehensive sanctions or embargoes administered by the United Nations, the United States, the United Kingdom, or the European Union.
- You are not on any relevant sanctions, denied-parties, or restricted-parties list.
- Your use of the Service does not violate any law, regulation, or third-party right applicable to you.
3. Your account
You create an account by signing a cryptographic message with your wallet (Sign-In with Ethereum) or by authenticating through Telegram. You are solely responsible for maintaining the security of your wallet, seed phrase, private keys, and any linked accounts. Any action taken through a valid authentication is deemed to have been taken by you.
You must notify us as soon as you suspect unauthorised access to your account. We are not liable for losses caused by your failure to maintain wallet or account security.
4. Your content and conduct
You retain ownership of any content you publish on the Service, including your display name, avatar, link labels, and link configuration ("User Content"). By publishing User Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, and transmit it solely to operate and promote the Service.
You are solely responsible for the legality, accuracy, and appropriateness of your User Content. You agree that you will not use the Service:
- To solicit funds for any illegal activity, including fraud, terrorism financing, or the sale of unlawful goods and services.
- To defraud, mislead, or misrepresent yourself or any third party.
- To impersonate any person, organisation, or project.
- To circumvent economic sanctions, launder proceeds of crime, or evade taxes.
- To distribute malware, phishing material, or content that infringes intellectual-property or privacy rights of others.
- To extract or harvest data from the Service by automated means except as permitted by our robots.txt and any published API.
We may remove User Content and suspend or terminate accounts that violate these Terms, with or without notice, at our discretion.
5. Transactions and risk
All on-chain transactions are irreversible. You are responsible for verifying the recipient address, selected network, token, and amount before signing any transaction.
Blockchains may experience congestion, reorganisations, downtime, or forks outside our control. We do not guarantee that any transaction will confirm, settle at a given price, or complete within a particular timeframe. Wallets, smart contracts, and third-party infrastructure can contain bugs or be targets of attacks.
Cryptocurrency values are volatile and may fluctuate significantly between the time a donation is initiated and the time it is received or converted.
6. Fees and taxes
We may charge a platform fee on donations. When applicable, the fee is disclosed in the interface before you or the supporter sign a transaction. Fees can change; the version shown at the moment of signing governs that transaction.
Blockchain network fees ("gas") are paid directly to the underlying network and are not under our control. You are solely responsible for determining and complying with any tax obligations arising from your use of the Service in your jurisdiction.
7. No financial or tax advice
Nothing on the Service constitutes financial, investment, legal, accounting, or tax advice. Before making financial decisions you should consult a qualified professional in your jurisdiction.
8. Third-party services
The Service relies on third-party components including public blockchain networks, RPC providers, WalletConnect, wallet providers, Telegram, and infrastructure providers. We do not control those third parties and are not responsible for their performance, availability, content, or practices. Your interactions with them are governed by their own terms and policies.
9. Intellectual property
The Service, including its source code, interface, design, trademarks, and documentation, is owned by us and our licensors and is protected by applicable intellectual-property laws. These Terms grant you no right to use our trademarks, branding, or any other proprietary material outside of normal end-user interaction with the Service.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. USE OF THE SERVICE IS AT YOUR SOLE RISK.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF FUNDS, PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF USD 100 OR THE TOTAL FEES YOU PAID US IN THE TWELVE MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold us and our affiliates, officers, employees, and agents harmless from any claim, demand, loss, or damages, including reasonable legal fees, arising out of your use of the Service, your User Content, your violation of these Terms, or your violation of any applicable law or third-party right.
13. Sanctions and export compliance
You may not access or use the Service in violation of applicable export, sanctions, or anti-money-laundering laws. We may block addresses, accounts, regions, or specific transactions where required by law or where we reasonably believe compliance requires it.
14. Changes to the Service and these Terms
We may modify, suspend, or discontinue the Service at any time. We may update these Terms periodically; when we do, we will revise the "Last updated" date above and, for material changes, provide in-product notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Termination
You may stop using the Service at any time and delete your account from the Settings page. We may suspend or terminate your access to the Service where we reasonably believe you have breached these Terms or applicable law, where we are required to do so by a binding legal order, or where continued access creates an undue security, legal, or reputational risk.
16. Governing law and disputes
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the operator's jurisdiction, without regard to its conflict-of-laws rules. The competent courts of that jurisdiction have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence provides otherwise.
17. Miscellaneous
These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreement on the same subject. If any provision is held unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our written consent; we may assign them at any time without restriction.
